If you were in north Toledo during last week's chemical leak, the fight has moved to court. Toledo resident Todd M. Hartford and Hartford's Fencing & Landscaping LLC filed a class action Oct. 23 in Lucas County Common Pleas Court. It names M.C. Tank Transport Inc., its parent Kenan Advantage Group Inc., and the terminal's plant manager.
The complaint says the defendants didn't keep enough chemical inhibitor in the tank or properly monitor its temperature, and that venting the tank let the release continue, WHIO adds. WTVG reports a second suit from a Toledo woman in the shelter-in-place zone. Cleveland.com details a class action led by Heather Keyes.
- Leak, per one complaint: about 5,500 gallons over about 47 hours
- Treated: 57 at hospitals per one suit; at least 30 per Hartford's
- Damages sought: more than $25,000, plus punitive damages and fees
Hartford's suit estimates 1,379 people lived in the one-mile evacuation zone and 49,527 in the three-mile shelter-in-place area. The court hasn't certified the proposed classes, and the filings don't establish that the companies are legally responsible.
The lawsuit counts far more people in the shelter zone than the evacuation zone
